If someone hacked my e-mail, is it possible to identify who did this, and can I use that proof as evidence, if I file a suit?

Information technology is most sophisticated weapon to identify any cyber crime anywhere from origin to termination stage, provided someone is able to expertly use that or gets help of experts.
