Date of birth correction on passport

(Querist) 10 March 2013 This query is : Resolved 
I need to correct my mothers Date of Birth on her passport. Below are the sequence of events.
- Passport was applied in the year 2001 and proof of DOB was the ration card copy(Passport Offices were accepting RATION CARD copies as proof of DOB during this period).
- Passport was renewed in 2010 with no change in DOB.
- In 2012 took a copy of Birth Certificate from Civil Registrar and realised the DOB on passport was incorrect exactly by one day.
- Applied for Re-issue of passport with Birth Certificate duly attested as proof.
- Passport Officer demands for another proof of DOB (School Leaving Certificate)
- Approach school for Leaving Certificate but unable to find records for that year. (No records are available with school for those years).

I'm not sure what should be the next course of action.

-Should I file 2 affidavits stating the correct DOB and unavailability of School Records for School Leaving Certificate and present them to the passport officer.

- My mother was born in Portuguese Goa in 1948 and I have the original Birth Certificate in Portuguese duly translated in English and attested.


Any pointers will be highly appreciated.

This is general rule of Passport Office:----
You need to make an application for an additional booklet with a declaratory order passed by a First Class
Judicial Magistrate directing the Passport Office to amend the date of birth. This is an essential requirement.

The only exception to this general rule is when the DOB is wrongly entered in the passport due to a clerical error.
In such cases, it should be possible to ascertain from the files of the concerned Passport Office that it was indeed
due to a clerical error.
