sir my maid's husband was working in post office as a postman (regular role)and was get his salary through his saving a/c open in post office. Last month post man get expired and in his saving a/c he had not made any nomination .
on date of death balance amount in his A/c was 1,15,642/=.
She is a very poor chap with one daughter about to marry.

The widow should apply and get legal heir certificate from the Tehsil office, based on the legal heir certificate she can claim the saving account amount from the saving a/c of her deceased husband.

Your concern for poor maid is appreciable but you have come with half facts and a comprehensive advise cannot be given
has she contacted post office?
If so what they advised?
has she applied for pension? (which also entitles her to free medical care)
has she applied for compassionate job?

" is quite irrelevant and clearly reveals lack of knowledge about procedure about claim to be filed with the Post Office in death case. In other words, instead of providing any solution to the problem due to his own uncalled for presumptions, he has preferred to discourage the claimant to file any claim. Post Office deals with Government Savings bank for and on behalf of the Ministry of Finance, Government of India, which is much more secure than any banking transaction with private banks. The amount cannot be swindled away by any official if that is appearing in his Savings bank passbook.
Hierarchy of Post Office authorities are delegated with different powers to sanction claims in deceased cases for payment to his/her legal heir/heirs even without submission of any legal heir certificate. Legal formalities are called for ONLY in case of heavy investment amount in the account of the deceased. Only consent of other legal heirs through affidavit may be required in favour of your maid.
Better help her by contacting the concerned Post Office and fill up the prescribed form, readily available with the Post Office Savings bank, for making claim in deceased case. Your maid servant is likely to get the amount including interest after sanction of the competent authority, even without going through any legal formality of legal heir certificate or succession certificate..

the forum is bound to appreciate your concerned for poor maid, who probably does not know her rights at all.
you want to help your maid and so far you have not indicated whether you really want to know if Post office persons have embezzeled the account (which is not child's play). If this has really happened then it is another case.
please get in touch with post master to know the procedure to claim the account proceeds.
But this S/B balance is not the end of word for her.
If she is really wife of a deceased govt employee (unless facts are other wise) then it is a surprise that none from her deptt informed her of the rights
why do not you get her apply for
(i) pension
(ii) gratuiry
(iii) Gp Insurance
(iv) PF
(v) salary balance till date of death
(vi) encashment of unspent leave at credit on death.
(vii) medical card:
(viii) maturity value in case he was member of any credit and thrift society in his deptt. compassionate job.
