Hi, My father passed away recently. He had a propoerty in his name. He is survived by his wife and 3 children (1 residing abroad). We intend residing in the house. What are the formalities required to be completed.

you have not disclosed what type of property your father had? 1. a flat 2. land

if you are not going to partitioned property, you may apply for mutation of names all the legal heirs in municipal records by making joint application along with death certificate of your father and legal heirs certificate.

If you want to reside n the property left by you , you can do that gleefully and no permission from any quarter is required. However if you want to identify and separate your share from the undivided property left by your father then you have to file a suit for partition.
