sir, I had purchased a land through registered document on 1-10-1991 from land owner on 10-10-1990 another person applied for court decree for said land and he got it on 31-10-1991 which document is valid one, he has mutated by ror act on 6-7-1998 on site we are the occupants but on records his name entered from 1998 what can i do now he is telling that land is his only

You are advised hereby that, as per you have stated that prior to your registration there was civil suit pending before the court, and subsequently it was decreed on 31-10-1991.You have registered the land on 1-10-1991. In the eye of law you are not the owner of that peace of land. Your registration stands zero value. The decree holder can disposes you by way of muscle power or by way of filing another civil suit for recovery of the said land.

By virtue of the court decree he is the owner of the property which you have purchased. You have no value. When you are in the possession of the property then on the basis of the decree he will file a execution petition against you and previous owner of the land stating that you are made as party in the execution petition because suit land is sold to you. after the decree it is subsequent event. In the execution petition you can file an application as an obstructor, but it will not be maintainable, for the time being some relief to you.

The querry is just incomplete.You have not mentioned whether you were first purchaser.The seller seems to have had prior agreement with some one,who must have filed the suit for specific performance and he won.Pending the litigation he sold land to you.U may notget the land but you can ask money back and sue him for damages..

sir , i have taken land of hari of extent 1.38acres which has already as a legal suit on him by venkat for extent 2.23acres of which hari's is 1.33acres and madav 0.30guntas
the court gave dercee for 1.23 acres without mentioning from whose land it has dismissed 1 acre . can i get that part of land?or not what i have to do now
