Deduction of tax

Dear experts,
A person's land acquired by the governament for the purpose of public purpose in 1988 and paid compensetation deducting some amount towards tax.later land acquistion officer (LAO) given a certificate of tax at source in FORM NO.16A in1995.The person did not claimed due to innocence.son of the person came to know that recently and wants to claim the same.in 1995 the son is 10 years old.KINDLY ADVICE TO CLAIM THE SAME.WHOM TO APPROACH.The person is an agriculterist having no taxable income

Yes the son can claim the same, if he was owner to the land.

Otherwise all such claims are time barred.

Wait a minute,

the son also became major in 2003, he can not claim now.

Dear Friend, The claim is time barred and son can not claim the same. Since according to the provisions of Income Tax Act, TDS deducted should be claimed in the same year in which amount is received.

Minor can not file Income Tax Return to get refund of TDS, through is legal guardian father/ mother of any other person declared by the court.You did not mention amount of refund, there is a notification of Central board of direct Taxes, U can claim time barred refund of TDS. Since It is deduction in your father's name he himself will file his return not his son.After becoming Major son can claim in father's absence as legal heir (but father must not be in the world).
