Defamation

Friends,
I want to know whether i can file a defamation suit against a whatsapp message which is send on whatsapp group and there are around 80 members in that group.Can any one help ???

If the message is defamatory then on the basis of such message posted in whatsapp group, you can file both civil and criminal defamation case.

Since facts are not available,it is impossible to ascertain whether the facts alleged are derogatory or not.But if they are, then surely you can choose to file one based on whatsapp publication.The important ingredient for defamation is publication.You can file it wherever the members of the group are residing.

The facts alleged should not only be do9rogatory but should be false as well. If not then there is no case for defamation.

The message should be Defaming you, it should be false and you got loss then you can file a civil as well as a criminal case against Other or persons spreading it. All the members who only read the message but do not spread it further are not offenders.
