Destitute to stay at ngo premises

(Querist) 06 February 2024 This query is : Resolved
Dear Learned Experts,

I am seeking guidance on whether a registered religious institution has the authority to offer accommodation to destitute individuals on the premises of the Trust for either a specific period or for long-term rehabilitation purposes. The Trust is motivated by its objectives to provide support to those in need, and currently, there are approximately 4 to 5 destitute individuals for whom the Trust is willing to extend such accommodation.

I have several queries regarding this initiative:

Are there any permissions required for the Trust to provide accommodation to destitute individuals, whether for a specific period or long-term rehabilitation?

Is there any specific legislation that regulates the maintenance of destitute individuals, and does it impact the Trust's ability to offer accommodation?

In the case where destitute individuals are not educated, is it necessary to obtain a written declaration from them, and if so, how can this be facilitated?

Is there a requirement to inform the local police department or any government official about providing accommodation to destitute individuals?

I sincerely appreciate your expertise and would be grateful for any suggestions or guidance you can provide on these matters.

Dear Sir,
Trust deed has the objects like relief to the poor, education, establish maintain orphanage, etc. Based on that can we admit them.
Is it ok to keep them at the premises of the trust. Do we need any permission to keep them.. or should we take any letter from them staying trust is not responsible for any things that may happen to them during their stay. Etc

You can do the service to the poor, education, establish orphanage and you can tell them that the trust is not responsible for any things. No problem.

If the trust deed provides for such charitable acts, then the trust can very well proceed with the object of the trust for which it was created.
There is no legal infirmity i it

Yes sir, the trust deed permits to do. However, I would like to seek your guidance on the queries I am seeking in respect of governing laws , permissions etc.. appreciate if I can helped with my queries

The governing law in this regard is the trust deed wherein you will find the object of the formation of trust.
If the deed confirms this provision extended to the so called destitute person, then there is no legal infirmity in proceeding as per the guidelines of the trust deed.

Thank you sir for your reply,
I meant the law that insists registration process and procedure to be followed to maintain for destitute homes.

Is it a destitute home or a trust run by the trustees.
If you want to convert this into a rehabilitation centre or a home for desititutes then you may have to follow the procedures as prescribed in law for this purpose, you cannot get one anser to all your questions.
you can decide whether you want to support the destitute as per the trust deed or to convert it into a home for destitute and proceed accordingly.
This decision can be taken only after a meeting of the trustees hence you all can decide about it in a meeting and pass a resolution which should be in accordance to the conditions of the trust deed.

Dear Sir,
It is a registered charitable trust. Under the charitable trust there are objects that can address the needs of orphans, destitute etc.

Now there are 5 women destitute who are in need of shelter.. under this circumstances can the Trust provide shelter at its penises. Is there any registration required with any government office to provide shelter or should we inform the police before we provide shelter as we don't know these women personally to be on safer side
