Non occupancy charges being added to my maintenance bill since the last two months

Respected Sir/ Madam,
I am residing in my mother's house since the last nine years with my husband and child in Panvel.My mother is staying with my sister in Chembur. Since the last two months our society committee has levied non occupancy charges on us. I asked them the reason and they are saying that a daughter cannot reside at her mother's house. The house has to be in my name. I found this reason very weird. I would like to know whether I have to pay the charges as per the housing society act which clearly states that such charges are not meant for daughters.
Seeking your legal advice in this matter urgently.

The bye law of the society seems to be illogical and not supported by law. You can lodge complaint with the Registrar of society on this issue.

Write to the society regarding this and if they do not agree file complaint with the Registrar of the cooperative societies with request to order for interim stay levying extra charges till decision.

Dear Sir/ Madam,
I have written a letter to the society, but the secretary is not ready to accept the letter. Instead, the secretary is saying that the rule is different for married daughters. Since I am married I have to get an authority letter by my mother on a 100 Rs Bond Paper stating that I am am allowed to stay in her house.
I showed him this printout also where it states

Family Member means: Group of persons which includes Husband, Wife, Father, Mother, Sister, Brother, Son, Daughter, Son-in-Law, Brother-in-Law, Sister-in-Law, Daughter-in-Law, Grandson & Grand-Daughter.

Non-Occupancy Charges CANNOT be levied to the above family-members of the bonafide Member. However, intermittent joint-stay of other family members OR friends, will not attract Non-Occupancy Charges.


I request you to kindly advise me. Seeking your help urgently
