Disobeying of governments orders (tn.govt)

(Querist) 07 December 2011 This query is : Resolved
Disobeying of Government orders are punishable or not ? GO disobeyed by government employees, the higher official also not care about it . How can sue against them ?
Guest (Expert) 07 December 2011
Depends purely upon the nature of orders. If you prefer to point out about the nature of such order, any specific opinion can be given on that. However, in normal course, disobeyance of Government order is an internal matter and treated as indiscipline on the part of the erring employee for which the concerned department takes disciplinary action against the erring employee within the department, itself. But, if some order affects services of any particular employees, the concerned affected employee is free to sue to department.

However, if any such order affects the public in general and the order is not implemented, that can be treated as failure of the Government and the matter can be taken up with the competent court through a PIL or individual petitions by the affected persons.

It is a departmental issue, even if it concerns public, no direct action lies against the said Government Officer.

If any GO is passed, any person who is thinks it is beneficial to him, can seek the HC for implementing that GO.
