If husband plans to file case for divorce on the ground of cruelty then what preparations are required before filing the case and what proofs would be required in the court to prove the crelty.

What will be the stand of wife and if she also says that she also want divorce then court will refer for MCD or both will have to contest the case.

These days how much these types of cases take.

Kindly advise.

These days how much time contested divorce case takes in Delhi

it takes 1-1.5 yrs if contested but since delhi as different district courts now the time is even lesser depending upon the Court to Court. amitminocha@yahoo.com

If the ground is physical cruelty then you have to get the MLR from the civil hospital which will be use aa a main evidence in the case proceeding. Regarding time the case takes will depend upon the work load of that court.

Divorce by mutual consent will be treated as AND not VS
iT WILL TAKE 1-1.5 YEARS AND AFTER FIRST MOTION IT MAY TAKE 6 MONTHS

For precaution you can file petition under Domestic voilence Act before filling the divorce case and get report from protection officer about cruelty.
