one man married two womens as hindu customs. the second lady apply divorce and maintance. but the husband not given to the divorce. who is the liable party of the maintanance.

i cant get ur question, see if a man married for twice then the first one is the legally weded wife and the second one is illegally weded the second wife not entitled for shares in the property but certainly she is entitiled for the maintanance.

As per hindu law 2nd marriage is void during the life of the first wife. Hence 2nd lady divorce petition is not maintainable because she has no right legally. Ist wife is only the legally wedded wife.

Law has changed now. under the provisions of DV Act, even a lady living in relation with a man even without marriage is entitled for the grant of maintenance allowance and in the present case the maintenance under section 24 of HM Act is not payable but definitely such lady is entitled under DV Act.

Yea DV act is to be taken into account along with HM act, As Rajeev is right in answering, raj makkas is also right in including his opinion.I agree with above comments.
