Dying in harness

A person was appointed on compassionate ground under dying in harness rules. But he failed in the training for the post on which he was appointed and was removed.
Is his removal legal and justified ? can he claim appointment to another post on compassionate ground?

Compassionate grounds appointment is offered only when a person fulfills other requisite requirements like age, qualifications, etc.,

Subsequent to his appointment if he fails to complete the training, such removal is justified. As he has availed the privileges extended under the rules, he cannot seek another post.

If you can provide the full circumstances leading to his removal, suggestions can be given.

I have posted this query in the forum also. Under the title "Removal of Compassionate appointee". The diseased employee was a lekhpal and his widow was appointed as lekhpal but was removed on failing in the training. her writ petition has been dismissed by the single judge.
