employer backed out

(Querist) 07 October 2009 This query is : Resolved
In case a employer has promised in a written email to share profits of the company 50 -50 with the employee(director)and then asking him to put resignation since profits are higher ,how can the employee file a case any lawyer ?
R.R. KRISHNAA (Expert) 07 October 2009
The contents of such a written email are clearly enforceable. The employee can file a case. But first issue a legal notice.

A case may filed on the ground of breach of contract.

Dear Sir ,

Thankyou very much for your kind response .
Beofore proceeding for giling a case I fear knowing the owner he would react by filing some "framed " case gainst me and would start fudging document to frame me (knowing his nature) my query is :

Does his case filing against me as a reaction to my case hold a strong ground?
is there an advantage always to the 1 who file the case first ?

OR can i just intimate him of my intention of filing a case against him to which he may file a case gainst me before me ?

regards
