Please guide sir,
Dear Sir,
At present property documents are not available in my side.All important documents of properties are available in elder brothers.My side not available any legal documents.You are requested to please guide me what is the first legal process in my partition right for claiming me.Firstly i am sending the legal notice is essential or not.

1. Sending of notice is not essential.
2. Filing a suit for partition, documents are not required provided the properties are not disputed by the other party.
However proper description of the same is necessary to identify the same.

By sending a notice for partition may bring the parties to a peaceful negotiation which sometimes will solve the problem, which if sought to be settled through court may take atleast ten years period to get disposed, hence issue a legal notice first and see their reaction and afterwards if it becomes necessary you may file a partition suit but you have to mention the schedule of property properly though you do not have the property documents/papers.
