Hello Experts,
There is a shop of Electronics Repairing in my house which had been on rent since last 20 years.Now Tenant don't want to vacate it.He is saying to vacate it after 5 years.and we are in urgent need of the shop for personal use.We have an old rent agreement about 10-12 years ago.Earlier we used to maintain rent Register.But in last 6 years, we didn't maintain the same.The house is in the name of my widow Grandmother having age of around 83 years.My Grandmother has 3 son and 1 daughter and all are married. Pls suggest your views about legal procedings?

Your case has very good merit.
Send the tenant an eviction notice and then file suit for eviction on the ground of bona fide requirement of the property.
Engage a civil advocate for this.

Sir, Generally we see the cases used to go on for so many years.and we are thinking of selling the property.In How much time case could be resolved?

No body can ensure you about time an eviction case may consume as it may go contested up to supreme court.
Make things amicable with tenant paying him some surrender fees or sell a little
dearer, the buyer would have more better rights of eviction than you.
you did not tell of which state the matter is? Rent legislations are different in states.

Yes, it indeed takes time to get resolved through court. In WB such cases take time for a decade.
If you are in hurry then get it better sold out and move out of this place.
