evidence

(Querist) 09 April 2010 This query is : Resolved
In any investigation, the judiciary is relying upon the State or it's agencies to collect the evidence, in the adjudication process. but as per the principles of natural justice, the State is not come under the bias, in cases against the state?
how the judiciary shall rely the State and it's agencies, in the adjudication process?
why not it suggest to have an independent institutional mechanism for adjudication process, with checks & measures, if any required?

Judiciary in various reported cases has suggested Government to frame such mechanism for the time and against but no favourable action is still visible. It is the pressure of the general public which shall work rather that of judiciary itself.

Agreed with Makkadji.

It is our fate. That's why our country differ from other Nations in the quality of justice delivered. Government or the Judiciary don't bother about this. Investigations are transferred from local police to CBI in some cases, that's all. But finally the result of fair investigation is a big 0.
