Ex-parte divorce

(Querist) 14 April 2011 This query is : Resolved
Sir,
I have filed divorce case against my wife. We have a girl child and she is living with her mom. My wife took all her belongings and not in touch with me over 2 months. She is unwilling to appear before court. My question is after how many hearing dates the Court will give me Ex-parte divorce?
Kiran Kumar (Expert) 14 April 2011
firstly the notice will be issued to her, if the court is satisfied that she has been duly served with notice and is not appearing then the matter will be posted for ex-parte evidence.

after the recording of ex-parte evidence the court will pass the decree.

this process may take 6-8 months...in fact depends upon the burden upon the court.

if your wife is not appearing then the court can order for publication in some news paper and even after that if she did not turn up then the court may proceed your wife ex parte.
