Expediting protest petition

(Querist) 25 June 2013 This query is : Resolved 
My property was sold by my forged signature in Faridabad Haryana. FIR u/s 156(3) was filed and my signature was verified before the magistrate. However, without making any enquiry the I.O. closed the case stating that it is a civil matter. I filed a protest petition which is pending and date after date is being given. Is there any way that I can expedite my case for early hearing or can I ask for CID enquiry as I do not have faith in local PS.

If your property has been sold by impersonation then doing what you are doing is not sufficient.

YOU DO NEED TO FILE SUIT TO DECLARE THE SALE DEED VOID AS THAT IS A CLOG ON YOUR TITLE DUE TO ITS" EXISTENCE ON REGISTER OF REGISTRAR.

THE SUIT IS REQUIRED TO BE FILED WITH IN THREE YEARS FROM THE DATE THE FACT BECAME KNOWN TO YOU WHICH YOU MUST HAVE STATED IN THE FIR.

HOWEVER I.O. HAS WRONGLY DROPPED THE CASE.

IMPERSONATION IS CRIME THE STATE MUST DISCOURAGE.

File a petition in the lower court requesting it to dispose of your protest petition in 2-4 weeks of time. If it refuses or fails to do so then go to high court and obtain order of speedy hearing.
