EXPERT ADVICE

Dear Friends,

I have joined LCI recently and was fascinated by the content of this site. It is a very useful site.

However, in the EXPERT section, I find some advises which are not expected from an EXPERT LAWYER.

I hope you will agree with me that there is a need to keep up the falling standards in our profession. If not the reputation of lawyers will be damaged beyond repair.

I invite expert opinion of my brother lawyers on enhancing the standards of the profession.

I also take this opportunity to appeal to the management of this website to consider having a moderator to check this.

Kindly note that my intention is only to enhance the standards of this good website but not to criticise or demean any member.

I appreciate your courage to bring this problme openly before the legal fraternity. It is the need of hour to reestablish the standards of this noble profession among the advocates. As the advocates are generally found indulging in unprofessional activities while doing this profession, the general public has started openly insulting and tuanting the whle community of Advocates and our image is changing like DALAL. This high degradation. Some days ago, a person wanted to engage me in a criminal case as an advocate in the matter of his brother who had been arrested in that case. When I told him to bring surety, he told that it is the duty of the advocate to arrange the surity. I was surprised to listen this. I tried to convince him but he told that in such and such courts, such and such advocate took such and such and such amount for arranging the surities, so this is the duty of the advocate and I can pay the amount for that.

If we all even indulge such type of things, definitely this is the dgradation. There are countless instances like this.

However, we are here to discuss the standards of the posting on this site. I also feel that we should prepare more before we put any reply on any topic in the forum otherwise conflicting views and even sometime beyond merits views not only damage the image of the site but also about that particular expert as well as whole experts penal.

I do agree with you.

I find certain advices in this section from experts who, please excuse me for this, do not have even basic knowledge of the subject. This results in conflicting answers on matter of fact leave aside law, degrading the standard of this forum.

I request the experts to benefit others with knowledge and experience they possess in their respective field of expertese rather than commenting on each and every querry.

Vineet sir i don't agree with you with regard to advice given here on this site.
There are some exceptional cases where wrong advice is given but i think that is not because of any deliberation but due to mistake.
Beside about confliction that also happens in case of a bench of even supreme court. I think confliction in topics provides a great deal of knowledge

Dear Anishji

I agree and repect your comments regarding conflicts in opinion. However there cannot be any difference in opinion regarding facts.

The only thing which I am indicating is that esperts section should retain its true colour and not be allowed to reduce to a general forum where casual, uniformed and sundry remarks are made.

Yes u r absolutely right Sir but some advice is always better than no advice , further it is upon the seeker either to act upon or to discard it.
