I HAVE A QUERY AT YOUR KIND END ;-
I REQUEST YOU TO SEND ME FOLLOWING INFORMATION;-
1. WHETHER RTI ACT IS APPLICABLE TO SCHOOLS?
2. WHAT ACTION SHOULD A SCHOOL AUTHORITY TAKE IF A THIRD PARTY DEMANDS A SCHOOL LEAVING CERTIFICATE ?
3. WHETHER ANY JUDGEMENT IN THIS REGARDS IS AVAILABLE ? IF YES PLEASE SEND THE LINK OR A COPY THROUGH EMAIL ATTACHMENT.
4. ALSO IF AVAILABLE A GR REGARDING RTI IS APPLICABLE TO SCHOOLS.

Dear Shekhar,
If a private school, the RTI won't apply to that school. However, if that is a Government school, the RTI is applicable.
School leaving certificate is issued to the student, not to the third party. Even if the school is a Government school, the third party can ask for information about date of leaving the school of a student, but not a school leaving certificate, if no office copy has been kept while issuing school leaving certificate to the student.

1. Yes. It has been mandatory now for unaided recognized schools to provide information to the applicants under RTI Act.
2. No action can be taken.
3. No judgment is required. Third party is not concerned without any specific authority by second party to obtain SLC.
4. Act itself covers schools.

The concerned PIO will have to write to the parties as it is a third party inform ation.
How ever as per the rti act,PIO can divulge this information,even if the other party does not agrees to it, on the grounds of "larger public interest".
