Bail modification at sessions court.

Querist : Anonymous (Querist) 24 September 2011 This query is : Resolved
Hi,

A false dowry case against me was filed. Holiday court/Killa court, Mumbai had earlier given me bail but with 25k surety amount for which we could not get solvency certificate.

At Killa court we have got extension to produce surety, the date is 27th September. Last week we submitted bail modification application at Sessions court, Mumbai but yesterday we got a date from there and the date is 7th October.

My question is that in such case how would the Killa court know that we have applied at Sessions court and that Sessions court has called us back on 7th October. Do we have to inform Killa court or does the Session court inform Killa court as soon as they get our application? Will Killa court take any action against me on 27th September?

Please advise.

You have to move an application before the Kila Court bring to its notice about the application moved by you before the Sessions court and the directions of the Sessions Court and then seek suitable adjournment. If you move the application before the Kila Court, it will not take any adverse action against you.

you have to inform the esplanade court informing the court that your application for modification of bail order is placed on 7th October 2011 . never surpress any facts from the court . no action will be taken if you make full discloures

Experts have rightly advised you, inform the killa court about whatever going on your behalf in session court and seek time accordingly.

Raj sir, the case is same but the query is different. Earlier I had asked about whether I can apply for bail modification, that was a few days ago. This is a brand new query a now I have applied for bail modification at sessions court and was not sure how would the judge at killa court would know about the date given by sessions court. Please refer to my previous query.
