Money recovery from a domestic bpo

Dear Sir/Madam, I need your help in getting my money from one Domestic BPO for candidates sourced by me for them.

I got a call from the Assistant manager of the company to come and meet him and after having an initial conversation with him in his office and understanding the process and payout details and i was told that i will have to source the candidates for them first for around 3 months and then after seeing our performance the contract will be signed.

It was decided that we will source candidates for them and an initial email from them with details of their requirement was also sent to me on the 31/8/11.

It was also decided that i should send the invoice after 45-60 days.

After working for them for around 2 months and asking them to pay for the candidates who joined through us, the reply given to me was since we have not been able to get them atleast 10 candidates in about 2 months so they won't pay us and payment can only happen when there is a contract and they are not ready to sign a contract with us since we have not given then 10 candidates.

This is the first time a company is doing such kind of open fraud. I was even told by one other consultant that this happened to him as well and he asked help from one political party and took a letter from one political party and then he was paid immediately. I don't want to do this.

These people are doing open fraud with consultants and are not paying them for their hardwork.

I didn't do anything since i thought i don't have a contract and so i cant do anything. But after speaking to one Lawyer i was told that we can send a legal notice to the company to pay for the candidates sourced by us since we have the emails from them.

Please advice is it worthed to send them a legal notice and what are the charges for sending a legal notice and whom should i contact and will i get paid for the hard work which we have put in for them. The amount they have to pay is 12000.

What happens if they don't pay can we take them to court and how much expense will be incurred if the case is filed and will we win the case. This company has been doing this type of fraud for a long time i presume and have become experts in this.

The amount which the company has to pay is 12000. It is actually more but about 12000 is what i can prove.

I would highly appreciate your help.

you can issue legal notice . for legal notice charges wont be more than Rs 2500. may be after legal notice they will settle your bill


wont advise you to file case as amount involved is only Rs 12,000

Dear Sir, Thanks for your reply. I have written to the company again. Lets hope they pay. Does the party to whom the legal notice is sent, do they usually pay up after receiving the notice.

If the case is filed and the case is won then can we ask the company to pay for the lawyer fees and court fees.
