This query is : Resolved
Hi,
We have 99.9% ownership in a private limited company which has a hotel property. This hotel property is in the hands of 0.01% share holder who does not have any management role nor director of the company.
So what are the options to take physical position of the hotel property of our private limited company?
Thanks in advance.

How come you are dispossessed from the property when you state to have 99.9% stake in the property?, seems to be academic query, come out with background details so that you will get proper opinion.

It is not academic... we started a hotel business. Since we have been out of the country, we let the minority share holder to maintain the hotel business. After realising he is committing fraud, we would like to take the management into our hands, which he is not letting.
We have all the documents to show our ownership..
Can we take police help through court or directly?
Are there any other means?
We would like to proceed legally only...
Thanks for your help!!!

Mr. Subba Rao,
Any reason for taking free advice, when your ownership in hotel business is at stake? Why not preferred to take regular consultancy by getting examined the case related papers from some neighbourhood lawyer?
Your statement, "It is not academic... " is unbelievable, as if a person posing to be a millionnaire/ billionnare seeks a free advice that itself denotes that the query is academic in nature, not real.
Anyway, if you have some real problem, you may like to reply my questions.

If you are not interested, you don't have to...
I am not asking you in particular...
This forum is to share information and expertise... else what for this forum?
If you don't feel like sharing your expertise, please don't. You don't have to waste your time by asking again questions...

Mr. Subba Rao,
Experience is not gained at our own cost just for solving students theoretical exercises. If you have some problem in reality, you must share the facts of the case. Merly stating that it is not academic cannot be treated as a real problem. Evem if you take a paid consultancy from any lawyer, you will have to state full facts and also have to show the case related documents to the lawyer for appropriate analysis.
When you have a problem pertaining to property of millions, you must also be ready to spend some paltry amount as consultancy fee and would have contacted some local lawyer instead of seeking free advice. Any rich person with such type of problem do not hanker after free advice. This tendency, itself proves that yours is an academic query.
Mind it, experts are not here to wste their precious time and allow misuse of costly infrastructure by spending from their own pocket just to provide free service to save your millions and billions. Experts are neither being paid by the LCI nor the querists for providing solutions. Voluntary free service is meant for help to the really needy and hapless sufferers, not for people like you.

I don't understand your problem... If you don't want to answer and waste your time, please don't.
You don't have to preach us what to do and what not to do... What is the infrastructure you are wasting? If you want to help needy , do so. Why are you wasting your time replying to our questions?
IF you have any problem please talk to LCI website.
If somebody is interested and has expertise, let him/her...
Let us stop this here... This is of no use...

Problem if not with me, but with you, when you people post hypothetical and vague academic queries tending to waste time of the experts. If you have posted your query in an open forum, anyone and everyone can give his observation. If you are reluctant in sharing the facts, you could have consulted any expert privately.
If you are a student, better concentrate on your study material and course books or hire services of some tutor to teach you. If you are a millionnaire, don't expect charity service from others for your commercial queries. You expect help, while you prefer to issue directives with all your arrogance.
Consult some local lawyer to solve your problem. You can well afford his fee.

Mr. Subba Rao,
Seeking a free advice by a billionnare hotel business owner is totally uncalled for.
As I have already made you aware, when you have come to an open forum, you cannot restrict anyone to make his observation or answer your question, or to issue any direction for him not to answer your question. Queries are open for reply by one and all. Some querists are genuine, where some gets exposed for posting hypthetical queries from their own description, as in your case. Why feel forced, feel free to make complaint to customer care, but which customer care? YOU ARE NOT A CUSTOMER OF EITHER THE LCI OR OF ME. You have not paid even a single paisa for hiring service of anyone. So, I can take your threatening as a blackmailing attempt on your part.
