The car accident family petiton 29,50,000rs But I am a poor family I Not claim this amount Which is giving to punishment in court And i small amount give to fine. I am car driver my monthly income 5000-8000rs And not claim in insurance Plz help what next

Your description about the problem seems to be not correct.

However, please clarify the following points:

1) Reason for huge penalty of Rs.29,50,000/-

2) Who is the car own, as per the registration paper, you or some one else?

3) Whether insurance was comprehensive or 3rd party?

4) What is the opinion of your own lawyer?

Your response does not contain reply to any of my questions.

However, I have seen the documents sent by you through email. You are not a party to the case. The case is filed against Mr. Venkatesh and Ramesh Nayak.

Not only that the case has been filed only on 10.01.2017 and the first date of hearing was of today.

So, how you are concerned with the case, more so when the case has yet to take its own process?

Your latest reply does not match with your earlier statement, "I am car driver my monthly income 5000-8000rs," when car driver was Venkatesh, not you.

Moreover, in the charge sheet only two respondents have been shown, while the insurance policy is in the name of the third respondent, whose name does not appear in the charge sheet. Who is that fellow?

Moreover the claim by the party does not mean the penalty to be imposed.

This is the start of the case. Ask Venkatesh to fight the case with the help of some good lawyer.

If your brother was driving the car as a driver, and he was on duty at the time of accident, then the amount has to be paid by the car owner/ employer.
