Non occupasion charges

Can anyone guide me about non occupasion charges charged by Housing societies. I am aware about the Suprem Court ruling regarding non occupasion charges to be charges 10% of maintenance charges if flat is let out on rent. My society has been chargeing me N.O.C. double the amount of my Maintenance charges for the last 6 years eg. If maintenance is Rs.500/- p.m. then society is charging me Rs.1000/-. I have pointed out them regarding Apex court ruling but they are adamant & unwilling to reduce the NOC amount. Kindly guide me whether I can claim for refund from society. Any procedure to claim the money.

you will have to lodge complaint against the society before the registrar cooperative societies of your ward .
in addition you can move the coopeartive court aginst the society for charging exhoribtant amounts as non occupancy charges
