A MAGISTRATE IS BASICALLY AN AGENT /POA OF GOVERNMENT WHOSE APPOINTMENT IS MADE BY THE STATE BY A LEGISLATIVE AUTHORITY.
ONE SEATED AS HEAD AT DISTRICT LEVEL IS CALLED DISTRICT MAGISTRATE UNDER WHOM ACTS AN ADDITIONAL DISTRICT MAGISTRATE(S),THEN THERE ARE SUB DIVISIONAL MAGISTRATES.
AS THE ROLE ALLOTTED THEY ACT AS EXECUTIVE AGENTS OF THE GOVERNMENT OF STATE.
APART FROM EXECUTIVE FUNCTION THEY BY LEGISLATION CAN BE CONFERRED WITH JUDICIAL POWERS TOO.
AS ALMOST ALL MAGISTRATES BESIDES THEIR EXECUTIVE POWERS ALSO ENJOY JUDICIAL POWERS IN RESPECT OF AGRICULTURAL LAND.
AND UNDER OLD Cr.P.C. THEY ALSO HAD JUDICIAL POWERS IN CRIMINAL MATTERS
WHICH HAS AFTER NEW Cr.P.C.HAS STOOD TO JUDICIAL MAGISTRATES(JMs)WHOSE HEADS ARE CALLED CJMs.JMs IN FACT OR JUNIOR DIVISION CIVIL JUDGES(KNOWN AS MUNSIFS IN PAST)AND CJMs ARE CIVIL JUDGES SENIORS DIVISION ALWAYS THEY WERE SO.
SPECIAL MAGISTRATES EXECUTIVE OR JUDICIAL ARE APPOINTED FOR EITHER SPECIAL PURPOSE OR FOR A SPECIFIC AREA.
