Drainage problem

I have agriculture land near the village. There are a way/ passage between the agriculture land and population(abadi) area. The disposal of used water of villagers are falling down in my agriculture land. What solution is available in constituon for this type of problem?

Can i represent the problem in high court or supreme court through Public interest litigation and how?

You have to file suit for declaration and injunction against neighbours whos waste water is falling on your agrl., land.

The act is nuisance actionable at law and a suit for injunction as well as damages lies.Criminal action is also attracted under IPC

PIL would squarely fail.

You better apply to the Municipality to do the needful. If it fails to redress the problem then file a writ of mandamus in the high court.

U should take up the matter with the local body. If it is a public drain, it is they who are to address this issue, but, if it is on your land, U should take steps to prevent it.
