Ipc 409

i have a complaint against 409 ipc from HDFC Bank. 3 yr before i was working with them as an agent . it was partnership firm. we lost near about 30 lac in this business and that was bank money. we covered 15 lac from our side but 20 lac is still there . now they suit a complaint against me in ipc 409. my question is can we take bail in that because it is NBW. and we don’t know about court name and fir no. we have only case no. so how i can get court name and all details is there any web site or some thing. from last 2 yr i m out of INDIA. I never receive any correspondence from court or police.

pls suggest what we can do next.

As soon as you shall come here in India, concerned police shall arrest you and all the details of the case shall be disclosed therein. You shall have to return even for filing AB.

yes you can get AB. better you can approach your high court..and am agree with makkad sir,. take necessary pre caution and come back to india..

Since it is criminal offence first procure bail and then engage a lawyer to fight your case in India.
Another option is wait till submission of Charge Sheet and then come to India for bail.

i m doing job in gulf , so if i will come to India for bail than they will allow me to go back?.
AB is possible in IPC 409 ?.

Yes. AB is possible if you sincerely try for that.

In legal field the first rule is: KNOW THE FACTS.

Ask/ gain knowledge, what stage the case is and where. Then apply for Anticipatory Bail/ Stay on arrest by being in touch with your trusted counsel in the area where the case is pending.
