Electrcity act 2003

(Querist) 29 November 2011 This query is : Resolved
One short question:- Can I treat non-credit of intrest on security deposits, a part of billing complaints?

Background:-
1. In Odisha, security deposits with electric company, earns intrest, which they credit in the monthly bills against the payments due.

2. In my case the same was not done for more than a year. Further, even the complaints were not answred to.

Hence, the question as above, as this may allow me to file compensation under billing complaint provisions.

Yes,

Send notice to the company and then take it to Ombudsmen.

@Biplab whe4n you quit the electricity service then elecricity distribution company pays you intrest from the date of deposite for that you have to submit original slip of security deposite. It is genral practice of elecricity distribution company not to credit the intrest amount in running bills hencenon-credit of intrest on security deposits,is not part of billing complaints

Dear Shrikant,
They do credit the annual interest in the bills of April/May itself. This is inline with OERC guidelines 2004. As per that guideline, this should be automatic. However, the OERC guidlines are silent about the categorisation of such complaints. I did go through the Electricity Act 2003, but didnot find anything in this regard.

Just a point that may interest you, as per OERC guidlines, Billing complaints should be handled within 30 days, failing which the company has to pay a fine of RS 50.00 for each day of delay. Hence, I was wondering the question as asked to all. So please help.

Dear Mr. Kapoor and Mr. Kumar,
The complaint is now with Ombudsman. The GRF(Redressal forum) did reprimand the company, but fell short of awarding compensation. Hence approached Ombudsman, where the company is challenging that this is not a billing complaint.
Hence forced to ask this question.
