when a parition suit is pending in a civil court and a petitioner is not a co-owner of disputed non-agricutureal land, inspite of he has filed a partition suit as co-owner of the property.
petitioner shown the disputed property as agricultural land and pay court fee stamp as agricutural land.
How much is court fee stamp is neccessary? and on which stage court decides necessary court fee stamp? I needed Judgements for that.

it would depend upon where property is situated and where suit is filed .

Court fee is applicable as per state law. local advocate or expert from Gujarat could advise.

As per your query, petition has been registered.The petition have not been returned by the court so far.Need not worry about the court fee. If the other party challenge the court fee paid,if the court order the petitioner to pay deficit court fee then petitioner have to pay the required court fee .

If one is not a co-sharer, he cannot file the suit for partition of revenue court partition of agricultural land as he has first of all to claim himself as a joint owner by way of a registered documents so if he fails to do so, his litigation goes with him.
