THE TRIAL COURT "TIS HAZARI" IS ADOPTING THE DECISION OF GIVING BAIL TO KANIMOJHI (recently) AS BASIC GROUNDS TO GIVE BAIL TO ALL ACCUSED AND UNDER TRIAL.
IS IT CORRECT TO ADOPT A JUDGEMENT AS "GUIDELINES" INSTEAD OF A SEPARATE NOTIFICTION BY "APEX COURT"

No, it is not correct and not possible that all bails are granted on this ground

Respected Sir - I saw your expert comment. my P.Hd married daughter is killed by her husband & family members & scene of suicide is given. the case is under trial of Tis Hazari court. The Hon. judge has considered the bail application ( rejected earliear four times by trial & high court) and has opened the date to give decision in first week of january-2012. Without comming in high lights (because he may further victimize me _father of deseased during trial witnessing to favour main accused i.e. husband)- how to handle with issue ? I do under stand that appeal may be made in upper court ; but in that case also same circumstial atmosphere would have to be faced. And once that acccused come out the danger to my entire family shall increase to any extent.From where I may get clear guide lines w.r.t. decision of "Kanimojhi" as given by "Hon. Apex Court" for consideration of bail applications _ particularly under sections 498-a , 304 & 34 of I.P.C. KINDLY ADVICE SUITABLY

MY SECOND PLACED QUERRY IS ANSWERED . I JUST WANT TO KNOW , WHETHER THERE ARE ANY GUIDELINES OF "APEX COURT" REGARDING GIVING BAIL TO UNDER TRIAL ACCUSED. BECAUSE IN INDIA THE LIFE OF FEMALES (particularly of married ones) HAS BECOME VERY CHEAPER & WAY TO EARN MAXIMUM MOST MONEY FROM PARENTS OF "DAUGHTER" AT TIME & POST MARRIAGE.
IS THERE SOME ONE WHO MAY LET ME KNOW ABOUT SUCH "GUIDELINES" OR "PROVISION TO ACCORD BAIL " TO SUCH HENOUS CRIMINALS.

It all depends on convincing points presented before the judge to get a bail. Any guidelines issued cannot suffice, as those guidelines are based merely on theoretical perceptions of mind of just a single person or at the most of a small group of persons involved in drafting/ processing of such guidelines.
