a person alleged to commit an offence of killing a wild animal belongs to schedule I of the wild life protection Act viz., a mouse deer and remanded to judicial custody 22 days back. the first bail application is rejected by the JM and an appeal preferred in the sessions court was also dismissed on the 21st day of remand by stating the reason that the 2nd accused is absconding and on release of first accused, the arrest of second accused is not possible. but the proerties were already seized and produced before the court. police not taken the accused in their custody for further investigation in all these 22 days.. what grounds we take in the next bail application?.. is there any favourable citations to ur knowledge..?.. he is the first offender.

You have no other option but to go to High Court seeking bail as Sessions Judge has already rejected your bail application.

what about a second application before the same sessions court after few days..?
