Dear Members,
There are certain CD's as an evidence given in court by other party in 125crpc case. I have clear doubt about authentication(tempering or cut paste have been done) in CD's. I have certain question on this:
1) What is the procedure to move CFSL application in court. How to convince MM.
2) If there is any recognized private lab in delhi. kindly specify any name.

in my opinion ask the court to send the cd to the state forensic lab with a direction to submit a report on it. But i have no capacity to explain how should u explain it before the court.

You can ask them to be tested in FSL laboratory.

to do so you should deny the compliment at the time of his cross examination in the point of genuinely of the cd and put some suggestions that the cd is not a genie one. There after file a written application seeking a direction for a forensic report at your cost. A c d is not a primary evidence it is a secondary evidence-remember that.

Either Court in a pending case can send sch CD for forensic lab or police during its investigation or you yourself can also do this from private lab. You may search such lab online.

there are two main Labs available...one in Chandigarh and another is in Gujarat...
move a necessary application for examination of the CD from a Central Forensic Science Laboratory and pay the requisite expenses for the required purpose.

Dear Mr.AB,
Mere production of cds as evidence is not suficient.The court will not blindly accept them as evidence unless proved that they genuine in every aspect.I do not know if you are the advocate or the client.If you are the advocate stress your defence on the authenticity of the cds by proper examination.
