Employee information to bank

Hi all,

I want to know that- can we provide the details of an employee e.g. phone number and address if he is a defaulter in paying EMI of loan of a Private Bank. What can be the legal implications.

Simply you can refuse to give such information.
It was for the bank to have collected those minimum information under KYC norms.

Is yours a govt. office or private office?If it is a govt. dept,as per the service rules and regulations,the employee has to disclose any liability that he has incurred,other then in his department.If you feel they are contrary to the rules and regulations you have to reveal the particulars to Bank where he has a liability.Yes,as said by Anirudh it is the duty of the lending institution of verify the loanee's official status also.If that has not happened,then you need not disclose anything.

You have no obligation to disclose.

The bank can get the same called through court.

Why those bankers ask you to produce all details. Is he default any loan to the concern banker. If he indicate ur company name in the occupation coloumn then you can provide their address. More over no implication arise because of disclose the adress othe employee of your firm. At the same time the banker can t force you to disclose the same

Not at all, if your organisation has not stood guarantee to recover the EMI on default payment of bank loan by the employee.

Employer should always be impartial and not to indulge in to the disputes of third parties with its employees.

Employee has the right to sue the employer for disclosing his private information to the third party and consequential loss or damage to him.

Agree wtih Mr Dhingra. What obligation do you have to the bank. They have to talk to you through court.

Just imagine if the bank plans recovery through goons anduse this information then what will be your position as abettor of the crime.

U R not legally bound to disclose; but morally you may have to. Govt or private, you are expected to know his whereabouts since employer can not give job to tom, dick and harry. If you disclose or not, you can not be legally held liable.
