Interest/damages on delay gratuity and pension

hi, my wife retired from bmc aided school in nov 2008.she got no pension & gratuiety till aug 2011 even though no compliance pending from her i.e. no fault of her, in months of july she got pending gratuiety & in aug 2011 arreiers of pension[2.25/1.97]resp.that means appro.3 yrs passed, therefore she lost interest.now she can claim interest @market rate and damages from athourity[mcgm] and how. now she is sr.citizen[62 yrs].this delay is only due to bribe that i & she denied,lastly i filed rti then final claim file mooved and got gra.,pension.thanks

You can claim interest under Payment of Interest Act.

If your wife had made representations to the concerned officials to release the desired benefits and despite of specific representations, the relief was not provided within a justified period, she is entitled to claim for the interest amount by filing a civil suit before competent court of law.
