This query is : Resolved
What's an alternative, if someone wants to purchase/sell a lease hold property, which under unavoidable circumstances, cannot be freehold.
Are there any papers in place, which can work as an alternative of sale deed ?

Dear Mr.Narang,
The Supreme has ruled in a landmark decision in Oct.2011 - that sale/purchase of leasehold property can be by way of a 'registered assignment of lease' only, after which the subsequent owner may apply for freehold.

The SC citation on registration of sale deeds given in Oct 2011 is entirely on different perspectives.
Please discuss it with particular wordings applicable to the query.

If a leasehold property cannot be sold due to some unavoidable circumstances then there is no any alternative of the registered sale-deed. All loopholes have already been closed by legal pronouncements.
