Sale of flat

(Querist) 21 November 2012 This query is : Resolved 
I live in a CHSL in Andheri (E). We are in the process of selling our flat that is we have started with removal of the household goods etc. The secretary of my society saw me loading the material in the truck and the next day I see a notice on the notice board that all prospective buyers of the flat in our society must meet the Secretary first. Is this move a way to harass the members of the society or is there a genuine reason behind this.

secretary is merely playing safe . any how you dont need NOC from society for sale of your flat

Prospective buyers have no need to meet first to the secretary as this is not the requirement of Property Transfer Act of India.

In Kolkata where we reside, it is a Flat amongst 96 Flats & all the Flat owners had formed a Society to register the Deed of Conveyances in the name of the individual members of the Society.Primarily the Society is the owner of which we are the members having one individual share of Rs.500/- each in the Society. It was done to avail the lower registration cost prevailed earlier for Societies.

Later on , whenever any member sold his Flat, he actually sold his share of the Society & the Society entered the name of the new buyer as new member & for that it charged a price unofficially as donation from the buyer for enrolling his name as a new member.It has now become a unwritten rule. It is now Rs.2 Lakhs.This tax collected from the new buyer/member as donation is used for mantenance of the buildings & running the Society.

Your Secretary also might be trying for any such booty if not he is trying to buy your Flat by discouraging all other buyers.
