Forming a housing society

HI,
There is already a housing society formed and now are intending to form a new society comprising a part of the existing society. The Survey numbers being different in it. We want to name our society as XXX(North) and it comprises about 130 plots. We are planning a meeting on 17 Feb, 2013 to invite all the plot owners (130) to be part of this meeting so that we can move ahead to create a society. We want to give a paper advertisement calling all the plot owners for the meeting. Do we need to have any legal process for placing the advertisement? Please guide us.

if ahousing society is already formed why dont you become members of the existing housing society . or form sep society of those who are not members of existing society .
small societes are ebtter . easier to manage . to mangae 130 members would be an hereculean task

Dear Mr. Sethi,
The society was formed about 2 decades ago and as of now the colony is still developing. We tried to talk to the existing society, but there is nobody interested or involved in this available to discuss. It will be another 5-8 years the colony develops well.
Some of us have built our houses and looking to work on the development programs. We are talking to all the concerned people and everybody is suggesting to form a society. we have now about 25 people.
To gather rest, we want to give a paper notice. Please advise if a legal document is to be shared to the advertisement. As of now we did not form the society, hence we don't have any legal documents. It is for this reason, we are appealing to all the other owners to be part of this.

where are you located? obtain details from builder who sold you the plots . if buidler does not oblige release advertisment if you so desire

the addresses of persons to whom plots have been sold . ask the builder only to form the society .

Dear Mr. Sethi, This locality comes under Gram Panchayti and the layout was made into plots. There were two people who made this layout and sold to all of us of whom one is no more. The other person does turn up but says he is helpless, So we don't know how to go ahead on this.

In the given circumstances, there is no legal hurdle if you invite plot holders by way of paper publication. Ensure the presence of the relevant people by any mode of communication.
So far legality is concerned, nothing is required at this stage as you all have to discuss the future modalities. it shall be better to ensure the presence of any legal expert in your meeting so that immediate legal opinion on either of the subjects may be taken from him.
