Possession of land

(Querist) 06 June 2013 This query is : Resolved 
Dear Sir(s),

My has only one sister and no real brother. Her family belongs to Shahjahanpur (U.P.). Her family members sold their property at Shajahanpur and purchased at Pilibhit, but all the property purchased against the property sold, the name of my Grand Father (Nana) was not included in the the names of new purchasers. The whole land was purchased in the name of his brothers.

My grandfather was expired 6-7 years ago but we have never claimed that property.

Now you are requested to please give me some idea that can we claim our share in that property including my aunt (mummy's sister).

Since the property was purchased in the name of grandfather's brother, you can claim your mother and your aunt share only if you are able to prove the source of money used for its purchase.
The court will allow your claim if you are able to prove that the new property at Pilibhit was purchased from the money which you got from selling the old property.
If you cannot prove this, then you will not get any share in the new property.
