304a of ipc

(Querist) 18 June 2013 This query is : Resolved
Hello respected experts,
What should be the grounds for quashing FIR in a case of 304A IPC accident case, where driver is not at fault, but death is caused due to sudden running of a baby of 5 years across the road ? Any other remedy ?
Nadeem Qureshi (Expert) 18 June 2013
Dear Sachin
If you have any strong evidence in your favour then file the quashing petition before HC with that ground.

Engage a good criminal lawyer and he would sort out the grounds from your case file and on the above ground. File quashing petition before the High Court.
R.K Nanda (Expert) 18 June 2013
file quash petition in HC.

Thanks to all for the advice. Will anybody pls share with me any authority of SC or HC matching with the above facts of the case, favouring the driver and resulting in his acquittal?
