(Querist) 29 October 2013 This query is : Resolved
Respected Sir
We are 7 children for my parents and I am the eldest
I have obtained permanent injunction order from the District court for my
self acquired properties against one of my brother. In that order the court has specified that either that brother or his relatives or his authorised persons on anybody through him should not disturb my properties
My question
1. Is the permanent injunction order applicable for only that brother alone or to other brothers and sisters too?
Pls re[ly me sir
Thanks

If property is self acquired,so injunction is applicable to all brother and sisters or any person.

The property acquired by members of such joint family is presumed to be joint family property or coparcenary property not withstanding fact that it was acquired without the aid of ancestral nucleus, unless contrary is proved. Parties by their conduct and treatment of property in their hands, can impress self acquired property with character of joint family property with character of joint family property.

Law is nothing but a common sense though this word common is not so common.

When you have obtained the stay order against a particular brother, how the same shall be applicable against others?

Answer to your query is only to the specified brother alone. You require to obtain similar injunction against all brothers and sisters if you wish to.
