Wrong sending the amount to third parties.

Dear Experts,
A company has to send some amount to ABC Company through Bank but by mistake sent the amount to ABC Company when the amount asked to ABC the are not replying despite notices and complaint to the concerned police.Bank officials are telling that they are no fault. It is learn t that ABC company is under liquidation. Kindly advice in this regard how to recovery the amount from the ABC Company? Thanq in advance.

You can initiate injunction proceedings through court of law, but be specific in your query.

You cannot take back the amount from ABC company, as the company is under liquidation. I think(it may be right or wrong) you are due some amount to the company and that either willfully or negligently transferred amount to ABC company and later it came to your knowledge, that ABC is under liquidation and now you are asking for return. If it is correct, you have not entitled to return back the amount.

If it was a wrongful transfer (without any liability to do so) on remitting company, send notice for the refund. If not refunded, file suit for refund and to mark lien on any balance in the account of ABC under liquidation till case finally decided.
