Hello Sir,

Can a Christian Husband or Wife file mutual consent divorce U/s 10-A of the Indian Divorce (Amendment) Act,2001.

If yes what are the documents required and and do we have draft it in the same way as we draft for Hindu Marriage Act, under Mutual Consent.

Yes under the Amendment Act section 10-A, Christian husband and wife can file a divorce petition under mutual consent. The documents required are : 1) Marriage certificate, 2) Wedding invitation card, if any, 3) ID proof for residence;

but to file in District Court, with proof of Baptism to prove religion,

+ Living Separate for Last TWO YEARS instead of One year.+ Priest Marriage certi from Church + Wedding Photos [preferred]+ strict proof of residence, to prove Jurisdiction. + Photo ID
