Waiving of cost imposed

(Querist) 05 February 2014 This query is : Resolved
Experts/Sirs,
While preferring an appeal before the Sr. Civil judge, in case of cost applied (due to misunderstanding which caused adjournment) is not waived of by the civil judge, please tell me the TIME/PERIOD in which such appeal should be filed under Order XL1 before the Sr. civil judge.???
Kiran Kumar (Expert) 05 February 2014
Are you sure that appeal lies against the said order before the Civil Judge (Sr. Div.)???
Mohan R (Querist) 05 February 2014
Experts here told me this. Is it not an appealable order?? What if civil judge dismisses my application u/s 151 of cpc. Instead of filing a misc petition under Article 227, what remedy do I have in the Dist. Court where cost was unjustifiably imposed on me by civil judge.
T. Kalaiselvan, Advocate (Expert) 07 February 2014
The author has been sufficiently advised by many experts to pay the costs and be free about it, but it appears he want to hold the bull by its horns to tame it, nothing more to add.
