Will

(Querist) 12 February 2014 This query is : Resolved 
My Mother in Law hails from Kerala. She has 2 brothers and 6 sisters. My Grandmother (mother in law's mother) wrote a will in favour of her 9 children including my mother in law before 2001. My Mother in law expired in 2001 and my grandmother expired in 2012.After the demise of my Mother in law, the said will was not corrected. Now there are some properties in my Mother in law name. Her legal heirs ( my husband and his elder brother) wants that property.

What necessary steps shall we take to get that property?

And my doubt is whether the whole Will get cancelled or only part of my mother Will would get cancelled ?

Get the will probated by your wife on the strength of said Will executed by your Grand MIL or file a suit for partition.
In case will is cancelled it can not be in part.

Discuss with the contents of the Will with all the beneficiaries and partition the properties as per the entitlements and get the partititon deed registered.

agree with sri vashishtaji.will cannot be cancelled in part as the person who created the will is not there.
further as viewed by sri vashishtaji and sri kalaiselvanji, probating the will is a right action.

Dear Dr. Vashista,

Please appreciate that it may not be the conscious attempt of the querist to post the query twice. Rather at times even after submitting the query, the querist does not get confirmation whether the query stands posted or not and in anxiety they click the button again which results in posting of the query twice.

Therefore, we should give benefit of doubt to the querists, unless the querist posts the same query / repeats the query after getting some answers. In this instance, that is not the case.
