(Querist) 23 March 2014 This query is : Resolved 
I did marriagr in jan 2013. Fron the very 1st day my wife start showing disrespect to me and my family.
she used to abuse me and my mother. And ahe gives threats to me that she will commit suicide as well as that their parents will file case against me and my family. Now I want to get divorce form her. Now what should I do to get divirce?

Try to settle the dispute amicably.
It takes an effort to work on marriage. Do not end it hastily.
If it fails to work still then , you can file suit for divorce.

Take help of common friends and relatives for an amicable solution.

If it does not work try for mutual consent divorce.

Try some councelling from a marriage councellor or some relatives to improve relations with your wife and see if things can be patched up. If nothing works, then consult some lawyer with all the facts in details to assess whether the ground of cruelty is made out from the available evidence. The allegations made, are to be proved in the court.

Constant threat to commit suicide is also considered as an act of cruelty, besides other acts. If there are no chances to the save the sacred institution of marriage and if divorce is the only relief and solution available, it is better to talk to her and go for a mutual consent divorce, if she is not willing then go for regular divorce, but beware of the fact that the criminal cases are likely to follow suit as a provocation to your act.

YOU CAN FILE A WRITTEN COMPLAINT IN THE LOCAL P.S. COMPLAINING WIFE IS INTIMIDATING YOU CRIMINALLY LIKE ( details of threat) and collect receipted copy for future reference if needed. This complaint will protect you from allegation u/s.498A IPC if arises in future.
