Incomplete query. Don't keep the experts guessing on your partial information, like 3 months passes (FROM WHAT).

Before I respond to your comments, "dhingra sir y u always so rude?
m sry...there is always a better to use words," I would like to ask you a very simple quetion, as a HEAD (as per your profile) of the organisation do you take decisions on the issues raised by your employees without knowing the background of such issues? If you do so, please don't expect others to follow suit, particularly, when legal implications are tried to be discussed by you.
BETTER WORDS are used only for those, who don't tend to waste time of experts. You must know that we are not charging anything from you for rendering our advice, but, if you want help of any one of us, you must not be so miser in providing the basic necessary information and tend to waste time of all of us by expecting us to presume about the facts, which only you know in your case.
So, you should not have expected appreciation or compliments from me for merely wasting the time of experts in guessing for you.
By the way, what was rude on my part, if I have advised you, "don't keep the experts guessing on your partial information, like 3 months passes (FROM WHAT)"?
In fact, some of your queries were quite vague. For example, I quote below your queries or part thereof, which are not expected from a person of the status of HEAD of some organisation without applying his mind while posting a query:
(1) what if 3 months passes and now we want to file 138 N.I case..what to do? (THE PRESENT QUERY)
(2) Please let me know what the difference between giving complaint to SHO and FIR in police station..
how to know we should file complaint in police station or FIR in police station/?
whats the diffrence?

(3) we not having proof that he has our phone or he is in possession of company asset, if we get that proof can we file suit"

JUST SEE THE LAST QUERY, you don't have the information what the company issued to your employee (not possible to be believed), but you wanted to ask for legal opinion without any base, as probably you have the desire to teach a lesson to your employee for dragging him in the court of law, irrespective of deficiencies prevailing in your own organisation.
This instance also intends to reveal that your company just wanted to fabricate a case against your employee just by creating a false evidence against him.
So, just think, what you can expect from the members, whose precious time is inteded to be wasted in response of your vague or doubtful statements?
