Attachment of property

One of the member of my society has taken bank loan from three banks. We came to know this when we search internet, we got notice issued by Debt Tribunal Dept. in diff cases. What surprise us was all three banks has attachment on same flat. Is this possible. cost of flat at that time (before redevelopment) was around Rs 25 Lacs & total loan from banks is more than 1.5 Crs. secondly, the gaurantor of loan is one of the member from family who does not have any source of income. One more thing, Society is not clear what adjustment they have done while redevelopment of society, bcoz we think that NOC of banks is necessary before demolition of old property. How can we know the exact status of case.

Dear Mr. Barman / Mr. Goyal, Thanks for taking interest in our asked query. Further, I am one of the MC member. After redevelopment of building we are trying to arrange records files of members flatwise. But this person has refused to give us any information about his flat. After that we searched further & found said facts. We MC members are having view that MC should be aware about legal status of each flat of society e.g. is the flat mortgage with bank for home loan, is the flat properly transferred to legitimate heirs etc etc. Secondly, the person for whom i have asked this query works with developer. He creates all nonsense in our meeting & by one or the other way stop society to work in betterment becoz current MC is opposing the developer to make commercial use of stilt parking of society. Our developer wants to make his permanent office in our newly build building stilt parking.
We MC members came to know about this site 1 n half year back & we started asking our queries here. Under guidence of experts from site, especially Mr. Sethi, who has shown right path to us & till date we have made so many positive changes in our society. Really Thanks to Mr. Sethi & all other experts who share their knowledge with ordinary peoples.

if the member is not furnishing details you can request the bank that has issued attachment notice to furnish copy of proceedings taken by bank against said member .
