Hello sir,
MY parents name was in the FIR but after submission of police diary they were not chagred yet that mean out of FIR,reason mentioned by the IO that
1) since my parent lived in madhya pradesh M.P and not ever came to Gurgaon after marriage only lived in rented house me and my wife in gurgaon
2) mentioned that marriage expenses done half half by both the family.
but still in the FIR mentioned all saman like sofa,Tv as dowary articles.
Now court called under CRPC319 to my parents now my question are above two reason is sufficient for saving my parents or any things else that i can suggest to my lawyer .

You are required to give facts of the case/dispute/FIR to your lawyer who is to analyse and guide/advise, correct yourself.On the issue of legal preposition it is your lawyer to advise you and not vice-versa.

Your parents are not charged but the court may ask for their presence to know their role better. Ask them to visit court and plea for their innocence.

Just act upon the court summons. unless warrant may be issued on your parents..

If the summons have been issued, ask your parents to be present in the court as per summons. Consult your lawyer.

U have not come out with the facts of the case or else we will not be able to advise U properly.Section 319 deals with proceeding against persons other than the accused,in case they are not co-operative,and this section has many sub sections.You say UR parents are not included in the original charge sheet,but they have to appear as and when required by the court.Accept the summons or else problems will escalate.
